WAI-LEGAL-TOU-v1-20260316 | Effective March 2026
Walking Adventures International, Inc. | 522 W Riverside Ave, Suite 7220 | Spokane, WA 99201
1. Acceptance of These Terms
These Terms of Use govern your access to and use of the WAI website. By visiting or using the site, you agree to these terms. If you do not agree, please do not use the site.
These Website Terms of Use (“Terms”) are a legal agreement between you and Walking Adventures International, Inc. (“WAI,” “we,” “us,” or “our”) governing your access to and use of the WAI website at walkingadventures.com, including any subdomains, successor URLs, and associated pages (collectively, the “Site”).
By accessing or using the Site — including browsing tour pages, submitting inquiry or brochure request forms, or registering interest in any tour — you agree to be bound by these Terms. These Terms apply to all visitors, users, and others who access or use the Site.
These Terms apply to the Site only. They do not govern your participation in a WAI tour, which is subject to WAI’s separate General Terms and Conditions. Where you register and pay a deposit for a tour, the General Terms and Conditions constitute the binding contract between you and WAI.
2. About the Site
The Site provides information about WAI’s walking tours, destinations, guides, and travel programs. It allows visitors to:
- Browse tour itineraries, pricing, and availability;
- Submit inquiries and brochure requests;
- Sign up for email newsletters and tour updates;
- Submit pre-registration deposits for future tour seasons;
- Register for tours and submit deposit payments through WAI’s booking platform, which WAI operates and controls.
Tour registration and deposit payments are handled through WAI’s booking platform, which WAI operates and controls. Registration submitted through the booking platform constitutes entry into a contract governed by WAI’s General Terms and Conditions.
3. Intellectual Property
3.1 WAI Content
All content on the Site — including tour descriptions, itineraries, photographs, videos, maps, written text, graphics, logos, brochures, ratings systems, and the selection and arrangement of that content — is owned by or licensed to WAI and is protected by United States and international copyright, trademark, and other intellectual property laws.
WAI’s name, logo, and tour brand identifiers are trademarks of Walking Adventures International, Inc. Nothing in these Terms grants you any right to use WAI’s trademarks, trade names, or logos without WAI’s prior written consent.
3.2 Permitted Use
You may access and view Site content for your personal, non-commercial use in connection with planning or researching a WAI tour. You may print or download a reasonable number of pages for personal reference. You may not:
- Copy, reproduce, republish, upload, post, transmit, or distribute any Site content for commercial purposes without WAI’s prior written consent;
- Modify, adapt, translate, or create derivative works based on Site content;
- Remove or alter any copyright, trademark, or other proprietary notices on Site content;
- Scrape, crawl, or systematically extract data from the Site by automated means;
- Use Site content to train machine learning or artificial intelligence models without WAI’s express written permission.
3.3 User Submissions
If you submit any content to WAI through the Site — including inquiries, testimonials, feedback, or photographs — you grant WAI a non-exclusive, royalty-free, perpetual license to use, reproduce, display, and distribute that content for WAI’s business purposes, including marketing and promotional materials. You represent that you have the right to submit that content and that it does not infringe any third party’s rights.
4. Acceptable Use
You agree to use the Site only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use of the Site. You must not:
- Use the Site in any way that violates applicable local, national, or international laws or regulations;
- Transmit any unsolicited or unauthorized advertising or promotional material;
- Attempt to gain unauthorized access to any part of the Site, its servers, or any system or network connected to the Site;
- Transmit any data or material that contains viruses, malware, or other harmful code;
- Engage in conduct that could damage, disable, overburden, or impair the Site or interfere with other users’ access to it;
- Impersonate any person or entity or misrepresent your affiliation with any person or entity;
- Use the Site to collect personal information about other users without their consent.
5. Forms, Inquiries, and Data Submission
The Site includes forms through which you may submit personal information to WAI — including inquiry forms, brochure download requests, newsletter sign-ups, and pre-registration forms. Submission of personal information through these forms is governed by WAI’s Privacy Policy.
By submitting an inquiry or brochure request, you consent to WAI contacting you in response to that inquiry and, if you have opted in, adding you to WAI’s mailing list. You may unsubscribe from marketing communications at any time using the unsubscribe link in any WAI email.
Pre-registration deposits submitted through the Site are processed by Stripe. Card details are handled entirely by Stripe’s PCI-compliant infrastructure and are not stored by WAI. Pre-registration is governed by the 2027 Pre-Registration Terms presented at the point of payment, in addition to these Terms.
6. Third-Party Links and Platforms
The Site contains links to third-party websites and services, including travel agent referrals (World Travel Inc.), travel insurance comparison sites, and other external resources referenced in tour materials. These links are provided for convenience and informational purposes only.
WAI does not control, endorse, or assume responsibility for the content, privacy practices, or terms of any third-party website or service. When you leave the WAI Site by following a link to a third-party site, you are subject to the terms and privacy policy of that destination, not these Terms. WAI is not liable for any loss or damage arising from your use of any third-party site or service.
World Travel Inc. and other travel agent or insurance referral links on the Site are provided as a convenience. WAI receives no commission or financial remuneration from these referrals. Travelers should verify coverage, terms, and suitability independently before engaging any third-party service.
7. Accuracy of Content and Pricing
WAI makes reasonable efforts to ensure that information on the Site — including tour itineraries, pricing, dates, and availability — is accurate and up to date. However, WAI does not warrant that Site content is complete, accurate, current, or error-free.
Tour pricing, availability, and itinerary details are subject to change. The current confirmed details for any tour are those stated in the most recent tour-specific materials and confirmed at the time of registration. In the event of a discrepancy between Site content and registration materials, the registration materials govern.
Brochure PDFs available for download represent tour details as of their publication date and may not reflect subsequent changes. Participants should confirm current details directly with WAI before registering.
8. Disclaimer of Warranties
THE SITE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WAI MAKES NO WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE OR ITS CONTENT.
To the fullest extent permitted by applicable law, WAI disclaims all warranties, express or implied, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement;
- Warranties that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components;
- Warranties as to the accuracy, reliability, completeness, or timeliness of any content on the Site;
- Warranties that defects in the Site will be corrected.
Your use of the Site is at your own risk. Some jurisdictions do not allow the exclusion of implied warranties; in such jurisdictions, the above exclusions apply to the fullest extent permitted by law.
9. Limitation of Liability
To the fullest extent permitted by applicable law, WAI and its officers, directors, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — arising out of or in connection with:
- Your access to or use of (or inability to access or use) the Site;
- Any content on the Site or linked from the Site;
- Unauthorized access to or alteration of your data or transmissions;
- Any errors, inaccuracies, or omissions in Site content;
- Any other matter relating to the Site.
In no event shall WAI’s total liability to you for all claims arising from your use of the Site exceed one hundred U.S. dollars ($100). This limitation applies even if WAI has been advised of the possibility of such damages.
Nothing in these Terms limits WAI’s liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited by applicable law.
10. Privacy
WAI’s collection and use of personal information through the Site is governed by the WAI Privacy Policy, incorporated into these Terms by reference. By using the Site and submitting personal information, you consent to the data practices described in the Privacy Policy.
The Site uses cookies and similar technologies as described in the Privacy Policy and Cookie Policy. Non-essential cookies are not set without your consent.
11. Changes to the Site and These Terms
11.1 Changes to the Site
WAI reserves the right to modify, suspend, or discontinue any part of the Site at any time without notice. WAI is not liable to you or any third party for any modification, suspension, or discontinuation of the Site or any part of it.
11.2 Changes to These Terms
WAI may update these Terms at any time. The effective date at the top of this document reflects the most recent revision. Continued use of the Site after an update constitutes your acceptance of the revised Terms. If a change is material, WAI will make reasonable efforts to provide notice. We encourage you to review these Terms periodically.
12. Governing Law and Disputes
These Terms are governed by the laws of the State of Washington, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Site shall be subject to the exclusive jurisdiction of the state and federal courts located in Spokane County, Washington, and you consent to personal jurisdiction in those courts.
If any provision of these Terms is found to be unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
13. Entire Agreement
These Terms, together with the Privacy Policy and Cookie Policy incorporated by reference, constitute the entire agreement between you and WAI with respect to your use of the Site. They supersede all prior agreements and understandings relating to the Site. These Terms do not govern your participation in a WAI tour, which is subject to WAI’s General Terms and Conditions.
